These Terms of Service ("Terms") govern your use of tandabourbon.com and related services (the "Site"), operated by Bickett & Smith, Inc. ("we," "us," or "our"). By using the Site, joining the Founders program, or making a purchase, you agree to these Terms. If you do not agree, please do not use the Site.
You must be 21 years of age or older and a legal resident of the United States to use the Site. By using the Site you represent that you meet these requirements. The Site is intended for personal, non-commercial use.
Joining the Founders program is free and subject to the Founders Program Rules, which are incorporated into these Terms. No purchase is necessary to join, and a purchase will not improve your standing. We may modify, suspend, or end the program at any time.
We offer non-alcohol merchandise and memberships for sale through the Site. Prices are shown in U.S. dollars and may change. Payments are processed by Stripe, and merchandise is produced and shipped on demand by our fulfillment partner. By placing an order you authorize us to charge your selected payment method for the total amount, including applicable shipping and taxes.
No alcohol is sold through the Site. Memberships and merchandise are non-alcohol products and are not a purchase, pre-sale, credit, or guarantee of any alcoholic beverage. Any future alcoholic products will be sold separately and only where and when we are legally licensed to do so.
We ship within the United States. Because merchandise is made to order, please review your order carefully. If an item arrives damaged or defective, contact us within 30 days of delivery and we will arrange a replacement or refund for that item. Membership terms, including any renewal and cancellation details, are described at the time of purchase.
You are responsible for the accuracy of the information you provide. Usernames and any content you submit must not be unlawful, offensive, infringing, or impersonate others. We may remove content or refuse or remove a username at our discretion. By submitting content (including a public username), you grant us a non-exclusive, royalty-free license to display it in connection with the program and our marketing.
You agree not to: use the Site for any unlawful purpose; submit false information or create duplicate, automated, or fraudulent sign-ups; interfere with or disrupt the Site; attempt to gain unauthorized access; or scrape, copy, or misuse the Site or its content. Violations may result in removal from the program and termination of access. Our contact and sign-up forms are protected by Google reCAPTCHA; by using them you agree to Google's Terms of Service and Privacy Policy.
The Site and its content — including the Tracey & Andrew's Bourbon name, logos, text, graphics, and videos — are owned by or licensed to us and are protected by intellectual property laws. You may not use them without our prior written permission, except as necessary to use the Site for its intended purpose.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Site. Our total liability for any claim relating to the Site or your purchases will not exceed the amount you paid to us in the 12 months before the claim.
You agree to indemnify and hold harmless Bickett & Smith, Inc. and its officers, employees, and partners from any claims, damages, or expenses arising out of your use of the Site, your content, or your violation of these Terms.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Kentucky, and you consent to their jurisdiction.
We may update these Terms from time to time. Changes are effective when posted on this page, and your continued use of the Site means you accept the updated Terms.
